Trespass In Pennsylvania

I have filed a formal complaint with the PA Gaming Commission asking that they investigate the legality and propriety of the casino practice of evicting a player who is neither unruly nor disruptive and is playing a game in accordance with the rules promulgated by the commission.  Moreover, I am asking the commission to consider the legality and propriety of a casino then threatening to have said player arrested for trespass should he/she ever return to the casino property.   I have asked for a full evidentiary hearing on the matter.   It would be very helpful for me to be able to produce testimony of others who have have suffered this practice by the casinos in PA.  Ideally, testimony will be provided in person.  However, if you are not willing to do that, I could prepare an affidavit for you to sign which would describe the incident you were involved in.  It may even be possible to file a document as a John Doe if you are concerned about revealing your identity.

The following text is what I filed today with the PA Gaming Commission.

Description of Incident / Dispute: I am asking the Commission to investigate and determine whether it is legal and or proper for any licensee (in this case, Live Phila) to evict a customer who is playing a game in a completely lawful manner and in accordance with all the applicable rules of the game as promulgated by the Commission and to evict such a customer without providing any reason for such eviction in spite of being asked to do so by the customer. Moreover, may a casino without just cause, threaten to have a customer arrested as a trespasser in the event that he should ever enter the property again following the eviction without cause. Details of the incident will be provided via documentation to be submitted after filing this form with the commission (specifically 2 letters to the president of Cordish Gaming). I request that an evidentiary hearing be scheduled in this matter for the development of a full record for the consideration of the Commission and/or the courts. I will also provide a memorandum of fact and law which I ask be considered by the Commission in this matter.

Does the PA gaming commission have rules that establish some framework by which casinos can't refuse service to any person for any reason unless otherwise protected by law, as any other private business can?

Good for you for standing up! Somebody eventually has to do it. I've had one complaint to PA Gaming, when it seemed like they were making up rules as they go along, but Gaming did not take my side. The risk of unpleasantries from the pit in PA casinos in general I would rate as halfway between the de minimis situation in Atlantic City, and that of the Vegas Strip. 

Regarding Live Philadelphia, I went there once after it opened and didn't see anything where I needed to go back, but that may have changed. And I picked up on an attitude from the patrons, and the table staff, and security that makes Sugarhouse seem like a Rotary Club meeting, and I felt that my bankroll (which we can't always hide at the table and the cage) as well as my person might be a target here. Win or lose the complaint, I wouldn't go back to that particular store under conditions of any conflict at all.
