Legalities on Indian land

I'm wondering what would happen if while at an Indian casino a player used a fake I D to obtain a player card, several months later they determined that that person was a Counter using an alias and had originally used a fake I D to obtain their player card. What legally could happen to that person? Could that person be prosecuted under federal law if this only happened on Indian land? What is the penalty? Shouldn't people have a right to know what their rights are on Indian land and what they can and cannot do? Where do we find their laws at?

How would they or any other casino know for sure you used a fake ID if they don't have that ID as evidence? They could photocopy it I guess when you sign up for a player's card, but I have never seen a casino do that at a player's club booth. Even if they did, I doubt they would have photocopied the back, in which case you could claim there had been a disclaimer on it stating it was a novelty ID.

But I digress, to find the Indian laws closest to you check out the National Indian Gaming Association website, or try contacting the tribe's human relations dept....or do something illegal in the casino, get arrested, go through the process, and let us all know about it.

I have no prob with being the guinni pig to a certain extent if I could find out first what the worst case scenerio would be if I got busted. Sure would be nice not to have to give them my real name when obtaining a new player card.

Who says you have to? Get a friend to do it. Play as a refusal. Be creative.

Does the friend need to be same gender and age range, etc.? In other words, if I play on a friend's card, does the floor pull up a record on me with the friend's descriptive info on it?

I can see where a guy might not be able to pass himself off as Trixie, but maybe Terry, Pat, Kelly, Kerry, Carrol, etc. unless, of course, the floor is looking at a record that indicates female.

To the best of my knowledge, it's not illegal under federal law to give phony ID to civilians, if it's not a fake "official" document.

Can it be illegal under one of the tribes' laws? Sure! But unless you are actually on an Indian reservation, I believe their laws only apply to tribe members. Even if you are on a reservation, I suspect it's a very sticky wicket. And they'd have a hellova public relations problem if it hit the newspapers they held someone for something that's legal elsewhere. I think that would be rare.

Where do we find their laws at?

You hire an attorney and pay him ~$500 to do a search. Or you join green chip and ask questions on the legal page, and if one of the lawyers who hangs out there is in a good mood ...

Other than address and Date of Birth (and possibly Sex) there is no descriptive info in the system. Simply be the same sex as your friend and roughly the same age (and know your friends DOB) and you are set.

There are a gazillion attorneys who understand and represent the rights of the Indians but zero who actually specialize in representation for the rest of us. Really an awefully one-sided legal system. I still think we can thank Gale Norton and the Dept. of Interior for a lot of the one-sidedness.

Even the people who work at the Indian casinos haven't even a clue.
Yesterday at an Indian Casino there were a couple of employees doing some landscape work and had a shovel on the sidewalk. I merely just stepped over the shovel and said hi to the worker. I couldn't believe the look on his face when I stepped over the shovel on the walkway. He stated to me, "I hope my boss didn't see you step over that shovel. You know how sue-crazy everyone is." I said, "If your boss gives you any sh't, remind him that it's impossible for U. S. citizens like me to sue the Indians. They can do most anything to anybody without risk of being sued. They have sovereign immunity." The guy just raised his eyebrows in awe as I walked away.
