Barred in PA

Can anyone tell me how a casino in Pennsylvania can bar someone for allegedly being a card counter? What are my legal rights?

THEY say they can barr you. Now, if you don't like that, you have the legal right to take them to court. Spend a lot of money on an attorney and after you lose the first couple rounds, maybe, just maybe the the Pa supreme court will agree with you. If they do, they will be only the 3rd such state behind NJ and Missouri that I know of to take this stance. (perhaps there are more that I am not familiar with) All the other states allow casinos to refuse service at will.

So, if you are lucky enough to win at this higher level after massive legal fees, they will no longer be allowed to barr you. You will have won a great victory and can return to play either their continuous shuffled game or their 12 deck, h17, 6-5, no surrender blackjack game, because they will surely do away with the more favorable rules that you enjoy now.

I assume you know this but others may not. NJ can't bar you but they can half-shoe you and limit your spread. Might as well be barred.

are private businesses and the state allows them the right to refuse service and refuse entry based on you being an undesirable customer. It is legal for them to do it as long as it's not based on a criteria prohibited by state and/or federal statutes (like color, sex, national origin, etc).

Sucks and I believe it to be a bad public policy to allow this. Whether there are other state laws (like laws requiring public accommodation when public amusements and such) that would require casinos to allow everyone inside that would restrict the casino's right to bar certain customers is another issue and only a lawyer could answer that. I know Louisiana used to have a public accommodation law that said casinos could not 86 people who were not causing a disturbance...thus players backed off could come back again and again and play and would have to be told every time not to play but could not be 86'd unless they refused to comply. Eventually the casinos lobbied the legislature to pass a law allowing any business with a gaming license to evict any patron for any reason at any time even if not causing a disturbance as long as that reason did not violate the various civil rights protections.

Apparently the business does. Here lies the problem. Nobody would argue that Nicodemo Scarfo, if he were not doing time in the slammer, could be considered an undesirable customer, but assigning that title to an advantage player who may be a respected doctor, lawyer, college professor or business man, is a stretch to say the least. So, when it gets down to the nitty-gritty, the deciding factor is how much money can they extract from this patrons pocket.

If Little Nicky, the day of his release from jail in 2033, walked into Parx and bought in at the craps table with $200,000 in fives, tens and twenties still dusty with cocaine, the casino host, casino manager and shift manager would all treat him like the second coming of Christ with brown all over their noses. So I guess, in reality, the dollar is, in the final analysis, the deciding factor when it comes to desiriblity in the casino business.

When they pull out the $5 to $50 placard; they restrict you to ONE hand.

when they pulled out that placard, none of the other players said anything. I've chosen not to play under those conditions but a 10-1 spread is not that terrible. After I was Id'd at Harrah's in AC, I had a free $15 play, so I was just going to play it and leave. Of course, I got a split and then doubled it and lost all. The best laid plans.

They shouldn't be able to dictate how you play. Unless it's their money and it isn't.

Betting $5 to $50 skillfully in a marginal shoe game will earn you close to minimum wage.

I would not play at that game with a max bet of $50. I was just saying a 10-1 spread is not bad. I very rarely play in AC at all over the past few years.
